Welcome to the Terms and Conditions section of Vamers Store. We dislike ‘Terms and Conditions’ as much as you do, unfortunately they are a reality and a part of conducting business. With that said, we will always try to keep them as straightforward, accurate and updated as possible.

Although boring, Terms and Conditions are necessary in order to protect both you and us. They essentially serve as a means to explain any issues that may cause problems.

Although we have tried to include everything that we think is appropriate here, every so often something might be amended or added. As such, please be sure to visit this page on a regular basis if you wish to be kept up to date with our latest Terms and Conditions.

Terms and Conditions

By visiting or using the HauptMediaGroup.com (“HMG”, “we,” “our,” “us,” the “Company”), Vamers.com and/or VamersStore.com (“VS”) sites or any other linked pages, features, content, mobile applications, and any other services we offer from time to time in connection with any of the foregoing (collectively, the “Sites”), you hereby acknowledge and consent to the following Terms and Conditions.

These Terms and Conditions are a contract between you and the Sites, with specific mention given to Vamers Store due to its commercial nature. Vamers sites (Vamers.com and VamersStore.com) are referred to in these Terms and Conditions as the acronym “VS”. These Terms and Conditions apply when you use the Sites and the VS websites (located at http://vamers.com and http://vamersstore.com), buy any products or services through the VS websites, and also apply to your use of any such goods and services. By accessing the VS websites you agree to these Terms and Conditions including the terms in our Privacy and Security Policy, which is a part of these Terms and Conditions. If you do not agree to these Terms and Conditions you must not use the VS websites.

Disclaimer and limitation of liability
The information, content, services, and features of the VS websites, including text, graphics and links are provided on an “as is” basis.  HMG does not represent or guarantee that the VS websites or any content, service or feature of the website will be error free, or will meet any particular criteria of accuracy, completeness or reliability of information, performance or quality. HMG does not give any warranty, express or implied, in relation to the operation of the VS websites.

HMG cannot ensure that any files or other data that you download from the VS websites will be free of viruses or contamination or destructive features.

HMG is not responsible for the acts or omissions of any third parties in connection with the use of the HMG suite of websites.

HMG is not liable for any damages, liability or harm caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction or unauthorized access to, alteration of, or use of the VS websites, whether for breach of contract, delict, or any other cause of action.

HMG is not liable for any indirect, consequential, special, incidental or punitive damages, including lost profits, even if HMG has been advised of the possibility of such damages.

If, despite the exclusion of HMG’s liability in these Terms and Conditions, HMG is found to be liable for any loss or damage caused, HMG liability is limited to $100 (United States of America Dollar).

These Terms and Conditions do not affect your statutory rights, including your rights under any applicable consumer laws that cannot be altered by contract.

Content on the VS websites
All content on the VS websites, such as information, text, pictures, photographs, graphics, interfaces, and the design, structure and arrangement of the content, belongs to HMG or is licensed to HMG and is protected by law. You may not copy, reproduce, upload or post any of the content on the VS websites without HMG’s prior written permission.

Links to third party websites
The VS websites may include links to websites operated by third parties. HMG is not responsible for the content of those sites. The links to third party websites from the VS websites do not imply any responsibility for the content, opinions, representations, products or services provided on those sites. You are responsible for complying with the terms of use of any linked third party websites.

Changes to VS websites
The content on the VS websites and the products and services offered may change from time to time. No notice of any changes will be given to you. HMG may also interrupt the operation of the VS websites, or any part of the website, to perform routine or non-routine maintenance, to correct any errors, or make other changes.

Termination
If you do not comply with these Terms and Conditions when accessing or otherwise using the VS websites, HMG has the right to suspend your access to the website temporarily or permanently without notice to you. HMG may also stop operating the website entirely.

Age
Registration and participation on VS is restricted to those individuals who are 18 years of age, emancipated minors, or those who possess legal parental guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations and warranties herein. By registering or participating in services or functions on VS, you hereby represent that you are over 18 years of age, an emancipated minor or in possession of consent by a legal parent or guardian and have the authority to enter into the terms herein. By using the VS websites you are representing and agreeing that you are above the age of 18 or, if you are below the age of 18, that you have the permission of your parent or guardian to use the VS websites and to buy goods and services through the websites. In any case, you affirm that you are over the age of 13 as VS is not intended for children under 13. If you are under 13 years of age, do not use the Sites. If you do not qualify or do not agree to these terms, you may not use the Sites.

Billing and personal information
In order to buy goods and services through the VS websites, you will need to provide HMG with certain personal and billing information that will enable HMG to charge you for your purchases (such as your credit or debit card details). You must provide accurate and complete registration information when you register an account. You must ensure that your registration information is kept up-to-date. Any personal information or billing information that you provide to HMG will be used and retained in accordance with HMG’s Privacy Policy. The Privacy Policy can be accessed at http://vamersstore.com/customer-service/privacy-security/ and forms part of these Terms and Conditions.

Order process
When you place an order for a product, your order is subject to product availability. If, after you place your order, there is insufficient stock to fulfil your order, HMG has the right to cancel your order or any part of your order and refund the purchase price. HMG will refund the purchase price based on the original payment method used.

You will have the opportunity to review any order for products or services that is placed through the VS websites. You can withdraw your order at any time before finally placing your order. Once an order has been placed and payment has been made, orders can no longer be cancelled and will be fulfilled as per these Terms and Conditions.

Payment processing
All transmissions of billing information and data through the Sites are encrypted and HMG takes extensive steps to ensure that any transaction through the VS websites is secure. Please note that SSL secure transactions will fall under Health World of Hans Haupt PTY(LTD) trading as HMG and the Sites. You accept that transactions that are performed over the Internet may be vulnerable to being intercepted. HMG will not be liable for any interception that occurs and any loss that is suffered as a result, where HMG has taken reasonable steps to prevent this happening. Please view our Privacy and Security Policy, which forms part of these Terms and Conditions, for additional information.

Terms and Conditions of sale, return and refund and cancellation policies
VS only deals in new merchandise, ensuring that you, the customer, only ever receive items in good condition and working order, and minimising the risk of faulty products. VS is unable to accept returns or swap items which are correctly supplied.

In the unlikely event that your goods received are incorrectly supplied/faulty/damaged please contact us via our “contact us” form within 48-hours of receiving the goods. The incorrectly supplied goods will be exchanged for the correct item/s.

HMG reserves the right to rather opt to credit the customer with the goods value in Vamers Store Loyalty Points. HMG would implement this method in certain situations (e.g. the correct product is not available in our warehouse or an order is cancelled before being shipped).

In order for VS to consider the return/exchange/refund of goods correctly or incorrectly supplied requires that all original packaging must be in good order and that the relevant proof of purchase must be supplied by the client.

Collectible merchandise may only be returned or exchanged if still sealed within original shipping materials or sealed in original packaging. Any purchased collectible item that has been removed from its original packaging cannot be exchanged or returned under any circumstances.

A courier collection fee of R300 for standard products and up to R2000 for collectible items may be charged on refunds and exchanges and a restocking fee of 20% of the original value of the goods will apply to some returns.

Customers acknowledge that making use of VS ‘Payment Plans’ requires an absolute and clearly defined non-refundable 25% payment/deposit of the total cost of the item being purchased. This is in accordance with the South African Consumer Protection Act (Chapter 2 Part C 17). Any merchandise purchased through VS that makes use of a ‘payment plan’ will not ship to the relevant customer until the entire amount of the ordered item has been paid for in full.

Non-returnable items include food products, undergarments, blind box items, products with downloadable content, promotional offer products, Flash Sale Friday products, competition or giveaway goods, and all other items as noted on the product page cannot be returned for refund or store credit.

Orders for in-stock items cancelled within 24 hours of being placed may be cancelled for a full refund. International orders may not be cancelled or refunded once shipped. In accordance with the South African Consumer Protection act (Chapter 2 Part C 17), a minimum of 25% of the total order value  will be applicable as a cancellation charge for all orders, whether pre-ordered or paid in full. Orders received for Pre-Order merchandise, whether it be a partial or full payment, secures the merchandise by means of a reservation. As such, all pre-orders are non-refundable. VS reserves the right to credit partial or full payments for pre-orders in the form of Vamers Store Loyalty Points that may be used against other merchandise. All payment plans adhere to an absolute and clearly defined non-refundable 25% deposit payment of the total cost of the item purchased. All credit paid over and above the 25% deposit payment in a payment plan will be credited to the customers account in the form of Vamers Store Loyalty Points.

Pricing changes
HMG reserves the right to, at any time and without giving you any advance notice, make changes to the prices of goods and services that are sold through the VS website and to correct any pricing errors that may inadvertently occur. HMG is not liable for any typographical errors that may occur.

Changes to the contract
HMG reserves the right to make changes to these Terms and Conditions at any time.  If you are an existing customer, VS will notify you in advance of any material changes that it intends to make to these Terms and Conditions before the changes come into effect. If you do not wish to be bound by the amended contract, you should not continue to use the VS website.

Delivery and collection
A courier company engaged by HMG will perform all deliveries of orders. You may be required to provide a valid form of identification when your order is delivered.

HMG is not liable for any incorrect order or delivery where you make an error in the information that you provide to VS (e.g. if you provide the incorrect delivery address or submit an incorrect order).

You acknowledge that the delivery of your order may be impacted by events beyond HMG’s control such as adverse weather conditions or industrial action. HMG is not liable for late deliveries of products purchased through the VS website. HMG will, however, try to ensure a smooth delivery process.

Vamers Store Loyalty Points

The Vamers Story Loyalty Points program, here on referred to as “VSLP”, is a customer loyalty program that is owned and operated by HMG. Your participation in VSLP is governed by the provisions set forth in these Terms and Conditions.

Loyalty Points are the rewards “currency” of VSLP. As a member of VS you will have the opportunity to earn VSLP by purchasing products and/or services offered by HMG or VS websites, or as offered and approved as promotions on VS websites from time to time, and/or by participating in questionnaires, surveys or contests. It is your responsibility to comply with the rules specified by each promotion or contest. Your eligibility to participate in any given Promotion or Contest, and your compliance with the rules for fulfillment of any given Promotion or Contest, will be determined solely by HMG.

Loyalty Points cannot be accrued until you are enrolled in VSLP. Loyalty Points will not apply for Purchases that occurred prior to your enrollment, unless otherwise indicated by VS websites, in which case your Account will be credited by the sole discretion of HMG.

HMG reserves the right to invalidate Loyalty Points posted to your Account upon notice by VS websites that you did not fulfill your obligation under the applicable Terms and Conditions.

HMG, at its sole discretion, determines the number of points to be awarded for any purchase, promotion, or contest. Purchases of equal retail value may accrue a different number of Loyalty Points without notice.

Not every Purchase on the VS websites will result in accrual of Loyalty Points. The purchase of Gift Certificates does not result in accrual of Loyalty Points. Redeeming a Gift Certificate will result in accrual of Loyalty Points when applicable. Purchases that are purchased solely with or discounted by a coupon or promotion received through the redemption of Loyalty Points will not accrue Geek Points. In some cases, as may be determined by VS, some purchases or promotions may not accrue Loyalty Points, and will be labeled as such on the VS website.

Once you make a purchase or fulfill all applicable requirements for a promotion or contest, the designated number of Loyalty Points specified by that purchase, promotion or contest will be transferred into your Account. In some cases, there may be some delay in the crediting of Loyalty Points to your Account. You cannot use multiple promotions for the same purchase. Loyalty Points will not be usable until HMG receives full payment for the order in which the Loyalty Points were accrued.

Cancelled purchases will result in loss of the applicable Loyalty Points accrued from that Purchase.

Purchases returned to VS websites for a refund will result in forfeiture of Loyalty Points accrued from that Purchase.

HMG will not be responsible for any delay or failure to credit Loyalty Points to your Account. It is your responsibility to regularly check your Account to ensure that Loyalty Points transfers have been properly credited and that your Account balance is accurate. If you contend that Loyalty Points have been earned but not credited, HMG reserves the right to require proof of accrual of such Loyalty Points from you, including but not limited to copies of receipts or similar documentation verifying any transactions claimed to have been performed. Any claims for Loyalty Points and proof of accrual of said points must be received by HMG within (30) thirty days after the date of purchase or risk forfeiture.

HMG reserves the right to audit your account and Loyalty Point accrual without notice for compliance with the rules set forth in these Terms and Conditions at any time. In the event that the audit reveals discrepancies, you may be subject to forfeiture of your Loyalty Points if said discrepancies are not resolved.

HMG is not responsible for changes to, or discontinuance of any promotion or contest, or for any effect on accrual of Loyalty Points caused by such changes or discontinuance.

HMG is under no obligation to provide VS website members with a guaranteed number of Loyalty Points opportunities or advise them of Promotion or Contest offers.

Privacy and security
These Terms and conditions include the acceptance and acknowledgment of the Privacy and Security policies set forth by VS websites and its parent company and can be found in full here.

Other terms and conditions
Additional terms and conditions may apply to specific products and services that are made available through the VS website and to other features that are made available on the site, such as competitions, giveaways and promotions. Those terms and conditions form part of these VS Terms and Conditions and you agree that you are bound by them. If there is a conflict between these Terms and Conditions and any specific terms and conditions applicable to any particular product or service or feature of the VS website, the specific terms and conditions will apply.

Interpreting the contract, governing law and dispute resolution
These Terms and Conditions are governed by the laws of South Africa, regardless of conflict of laws principles.

A court may find that some of the provisions of this contract are not enforceable. If this occurs, the remaining provisions of the contract will continue to apply. HMG will replace the affected provisions with new provisions that achieve the intended purpose but that are capable of being enforced in your country.

You and HMG consent to the exclusive jurisdiction of the High Court of South Africa, Johannesburg for all disputes arising out of or relating to this contract.  If you make a claim under your contract with HMG, as set out in these Terms and Conditions, you must do so within six months of the date when the cause of action arises.  If you do not do so, your claim will be barred.

Record of your transaction
If you need to obtain a sales record of your transaction to buy goods or services through the VS websites, you can contact HMG within 30 days of the transaction and we will gladly assist.

Any legal notices for the attention of VS under this contract must be sent by registered post to P.O. Box 1919, Benoni, 1500.

Where HMG needs to give you any notice as provided for in this contract or provide additional information about the products and services supplied to you, HMG will do so by sending you an email or posting a notice on the VS websites. You consent to HMG providing you with notices or information in this way.
